This Privacy Policy explains how Highroad Digital Assets Trust ("we," "us," "our") collects, uses, shares, and protects information through BestEstatePlanningIn.org (the "Site").

BestEstatePlanningIn.org is an independent advertising directory of estate planning attorney listings and third-party events. We are not a law firm, we do not provide legal advice, and we are not a lawyer referral service. This Site is void and unavailable where prohibited by law.

1. Scope and Acceptance

This Policy applies to visitors ("Users") and to attorneys, firms, and event hosts submitting listings ("Listing Parties").

By using the Site you acknowledge this Policy. Where applicable law requires consent for a specific practice, we obtain that consent separately through an affirmative, unchecked opt-in at the point of collection. Continued use of the Site is not treated as consent to marketing or to the sale or sharing of personal information.

Your electronic acceptance constitutes a legally binding signature under the U.S. ESIGN Act.

2. What We Collect

Most people use this Site without giving us anything. We collect information in only three situations: you submit a listing, you leave a review or comment, or you contact us.

Information You Provide

Listing Parties: name, firm name, business email, business phone, business address, bar number and licensing information, practice areas, service areas, biographical content, logos, and billing information. Payment card data is processed by our payment processor and is not stored by us.

Reviews and comments: the display name and content you submit, and the email address used to submit it.

Contact form: your name, email address, and the message you choose to send.

Information Collected Automatically

  • IP address and coarse location derived from it (city or region level)
  • Browser type, device type, and operating system
  • Pages viewed, links clicked, referring URL, and time on page
  • Access times and aggregate usage patterns
  • Cookie and advertising identifiers

Electronic Signature Records

When you accept our Terms or submit a listing, we record IP address, timestamp, and browser information to verify acceptance under the ESIGN Act.

Information from Third Parties

We may compile listing information from public records, state bar directories, licensing authorities, and business registries. This is business contact information about a professional practice.

3. What We Do Not Collect

We want to be specific, because this Site covers topics that can touch on health and family circumstances.

We do not collect health information. We do not ask about, and we ask that you not provide, your medical condition, diagnosis, disability, care needs, benefits eligibility, family circumstances, assets, or the details of any legal matter. Our forms do not request this information and we have no use for it.

We do not collect or process consumer health data as defined by the Washington My Health My Data Act, the Nevada consumer health data law, the Connecticut Data Privacy Act, or comparable laws. We do not sell it, share it, or use it to build audiences or profiles, because we do not have it.

We also do not collect: precise or GPS-level geolocation, biometric data, audio or video input, government identification numbers, or the content of keystrokes in form fields.

We do not use session recording or keystroke capture on any inquiry, contact, or listing submission page.

Do not send us confidential information. Content articles on this Site describe legal topics for general education. Reading them tells us nothing about you beyond an anonymous page view, and we do not use article topics to infer anything about any individual.

4. Cookies and Tracking

We use cookies and similar technologies to operate the Site, remember preferences, prevent fraud, measure traffic, and deliver advertising.

We may use Google Analytics and Google AdSense. We may display third-party advertising.

Your controls. You may set your browser to decline cookies, though some features may not function. You may opt out of interest-based advertising through the Network Advertising Initiative, the Digital Advertising Alliance, and Google Ad Settings.

Global Privacy Control. We recognize and honor GPC and other universal opt-out preference signals as an opt-out of sale and sharing where applicable law requires.

  • Prevent fraud and abuse, enforce our Terms, and protect our rights
  • Comply with legal obligations and lawful process

We do not use personal information to make automated decisions producing legal or similarly significant effects.

6. How We Share Information

Published publicly. Listing Party business information and submitted reviews are published on the Site. That is the purpose of submitting them.

Service providers. Hosting, payment processing, email delivery, analytics, and security vendors, bound by contract to use information only to perform services for us.

Advertising and analytics partners. We may share device and behavioral data with advertising platforms for measurement and targeted advertising. This may constitute a "sale" or "sharing" under state privacy law. You may opt out at any time using the footer link.

Marketing partners, affiliates, and sponsors. Only if you affirmatively opt in. See Section 7.

Legal and safety. To comply with law, legal process, or governmental request, or to protect rights, property, or safety.

Business transfers. In a merger, acquisition, or asset sale, with notice posted prominently on the Site.

Aggregate and de-identified data, which does not identify any individual.

We do not share User information with attorneys for the purpose of soliciting that User as a client. We do not generate, sell, or broker legal leads. Users contact attorneys directly.

7. Marketing Consent

Marketing communications and sharing with marketing partners require separate, affirmative opt-in by checking an unchecked box at the point of collection. Consent is never a condition of using the Site, searching, leaving a review, or creating a listing.

If you opt in, Highroad Digital Assets Trust, its affiliated and commonly owned businesses, its advertising sponsors, and the marketing partners identified on our Marketing Partners page may contact you at the information you provided, for their own marketing purposes, by email, mail, telephone, and text message, including calls and texts placed using an automatic telephone dialing system or artificial or prerecorded voice, at a wireless number.

Consent is not required to purchase anything. Message and data rates may apply. Message frequency varies.

Withdrawal. Reply STOP to any text, use the unsubscribe link in any email, or submit the Site contact form. We honor withdrawal across all channels within ten (10) business days. Withdrawal does not affect transactional messages about your listing or account.

8. Your Privacy Rights

Depending on your state of residence, you may have the right to:

  • Know and access the categories and specific pieces of personal information we collect, use, disclose, and sell or share
  • Correct inaccurate personal information
  • Delete personal information we hold about you
  • Obtain a portable copy of information you provided
  • Opt out of sale, sharing, targeted advertising, and profiling
  • Limit use and disclosure of sensitive personal information
  • Withdraw consent previously given
  • Not be discriminated or retaliated against for exercising any right

How to exercise. Submit a request through the Site contact form or the "Do Not Sell or Share My Personal Information" link in the footer. We will verify your identity before acting. An authorized agent may submit a request with proof of authorization.

Timing. We confirm receipt within ten (10) business days and respond within forty-five (45) calendar days, extendable once by an additional forty-five (45) days with notice. Opt-out requests are processed within fifteen (15) business days.

Appeals. If we decline your request, reply through the same channel with the word APPEAL. We will respond in writing within sixty (60) days with our decision and reasoning. If the appeal is denied, we will provide a method to contact your state Attorney General.

Fees. Requests are free unless manifestly unfounded or excessive, in which case we may charge a reasonable fee or decline, with an explanation.

9. State-Specific Disclosures

California. Under the CCPA as amended by the CPRA you have the rights in Section 8. In the preceding twelve months we collected the categories listed in Section 2 and disclosed identifiers and internet activity to advertising and analytics partners, which constitutes sharing. We do not sell personal information for monetary compensation. We do not sell or share the personal information of anyone we know to be under sixteen. We do not collect sensitive personal information as described in Section 3.

Washington and Nevada. We do not collect, process, share, or sell consumer health data. See Section 3.

Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Indiana, Kentucky, Rhode Island, and other states with comprehensive privacy laws. You have the rights in Section 8 to the extent your state law provides them, including the right to opt out of targeted advertising, sale, and profiling, and the right to appeal.

Maryland. We do not sell sensitive data and we limit collection to what is reasonably necessary to operate the Site.

Residents of any other jurisdiction may submit the same requests and we will honor them on the same terms as a matter of practice.

10. Do Not Sell or Share My Personal Information

To opt out of the sale or sharing of personal information for advertising, use the "Do Not Sell or Share My Personal Information" link in the Site footer or the Site contact form. We also honor Global Privacy Control signals automatically. Opt-out requests are processed within fifteen (15) business days and do not require creating an account.

11. Data Retention

  • Listing and account information: life of the listing plus twenty-four (24) months
  • Reviews and comments: for as long as published, plus twelve (12) months
  • Contact form submissions: twenty-four (24) months
  • Payment and transaction records: seven (7) years, as required for tax and accounting
  • Electronic signature and consent records: life of the relationship plus four (4) years
  • Analytics data: twenty-six (26) months

When information is no longer needed we delete or de-identify it.

12. Data Security

We implement commercially reasonable technical, administrative, and physical safeguards, including encryption in transit, access controls, and vendor diligence. No method of transmission or storage is completely secure and we cannot guarantee absolute security. You are responsible for safeguarding your own credentials and devices.

13. Children's Privacy

The Site is intended for adults. We do not knowingly collect personal information from anyone under eighteen (18), and we do not knowingly collect personal information from children under thirteen (13) as defined by the Children's Online Privacy Protection Act. We do not sell or share the personal information of anyone we know to be under sixteen (16). If we learn we have collected such information we will delete it promptly. Contact us if you believe a minor has submitted information.

14. Third-Party Links and Services

The Site links to attorney websites, event host pages, advertisers, and other third parties. We do not control and are not responsible for their content or privacy practices. Your use of those sites is governed by their own policies.

15. Disclaimers

All information and services are provided "as-is" and "as-available" with no warranties of any kind. We are not a law firm, do not provide legal advice, do not verify any listing, and make no representation about the accuracy or reliability of any listing or content. "Best" is a trade name only and is not a rating, ranking, or endorsement. Users are solely responsible for evaluating any attorney.

We make reasonable efforts toward accessibility but do not guarantee conformance with WCAG or any other standard.

16. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability for any claim arising from this Policy or from the collection, use, or disclosure of information shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).

This limitation does not apply to, and nothing in this Policy waives, any right or remedy that applicable law makes non-waivable, including statutory damages, penalties, and attorneys' fees available under state data breach or consumer protection statutes. Nothing here limits liability for fraud or willful misconduct.

17. Governing Law and Disputes

This Policy is governed by Ohio law without regard to conflict-of-law principles. Before initiating any proceeding you must attempt informal resolution for thirty (30) days through the Site contact form. Disputes not resolved informally may be brought in small claims court where eligible, or resolved by binding individual arbitration administered by the American Arbitration Association in Ohio, with class actions waived. You may opt out of arbitration by written notice through the Site contact form within thirty (30) days of first acceptance.

This choice of law does not deprive any consumer of the protection of mandatory provisions of the law of their state of residence, and does not waive any statutory right of action that state law makes non-waivable.

18. Changes to This Policy

We may modify this Policy at any time. Material changes will be posted with at least thirty (30) days' notice and an updated Effective Date. Where a change would materially expand our use of previously collected information, we will obtain fresh consent where required by law rather than relying on continued use.
